15 to face indictments in South Bay case (Sam Spital)

“A previous criminal probe involving officials in three school districts in San Diego County has expanded to now include 15 who were indicted for 232 felony and misdemeanor charges related to bribery and conspiracy in an ongoing ‘pay for play’ corruption case in connection with construction contracts entered into by district officials was reported by the UT News on January 7, 2013. The case involves campaign contributions, tickets to plays and sporting events as well as lavish meals, etc. in exchange for multi-million dollar school construction bond contracts.

At least one defense counsel was reported to be discussing a severance of the multiple cases so all of the defendants are not prosecuted together. The public’s interest in receiving information regarding the criminal case and the defendants’ right to due process and to have a trial free of adverse publicity has to be balanced by the court, with such a claim likely to be made by at least one of the defense counsel. The court will also have to manage this complex case with over a dozen defense counsel seeking to make a series of arguments and motions on behalf of their respective clients. Also, this case will no doubt proceed over many months, and here will be some defendants who will enter guilty or nolo contender pleas (plea in which one declines to admit or dispute the charges); it is even possible immunity may be given by the prosecution to some of the offenders if they have not done so already in helping to build their case. In spite of all of the allegations and innuendos, one always needs to be cognizant of the fact a person must be deemed innocent until proven otherwise.”

Thieves lived off jewelry heists, casino robbery (Sam Spital)

“The UT San Diego news reported on December 3, 2012 two leaders of the robbery of multiple high-end jewelry stores and a casino in San Diego were found guilty and now face sentencing. Their crime spree began about a year ago and it was alleged their ‘team’ seized millions of dollars worth of merchandise and cash. Besides Barona Casino, Ben Bridge Jewerlers in Fashion Valley, they targeted expensive jewelry boutiques in malls throughout California, including Santa Clara, Riverside and Orange County.

The article did not include any statements made by the criminal defense counsel, such as either defendant expressing remorse, recognition of wrongdoing, their presentation of closing arguments and/or mitigation. It is likely the sentence will be life in prison. Whether print, broadcast or electronic, the news media in large part fails to provide a balanced account in reporting crimes so that the public is more fully informed.”

Nurses Videotaped in Sex Acts Worked for Unlicensed Company (Sam Spital)

“This story was updated and published on November 8, 2012 by San Diego Channel 6 News regarding two registered nurses who were caught by home surveillance equipment and videotaped masturbating and performing oral sex on each other near, as well as kissing and fondling, a female stroke victim who was 98 years old. The nurses were referred by AMS Home Care Solutions, which reportedly is not currently and never was licensed by the California Department of Public Health to provide skilled nursing care (apparently AMS applied in May, 2011 for, but was not granted, a license). On October 24, 2012, an Administrative Law Judge (ALJ) issued an Interim Suspension Order (ISO) against the nurses. Pursuant to Code of Civil Procedure, Section 1094.5, either or both of the nurses can obtain judicial review of their respective ISO by filing a Petition for a Writ of Mandamus in San Diego Superior Court in which the judge will decide if there was an abuse of discretion by the ALJ in imposing the interim Order. The Board of Registered Nursing has up to 15 days to file an Accusation in connection with the above case in which the nurses face an outright revocation of each of their RN licenses. If a Notice of Defense is timely filed the nurses or either one are entitled to a hearing or trial within 30 days. There were no responses by defense counsel and, therefore, it is uncertain what strategy or arguments will be made on behalf of their respective clients.”
